THE MAXIMUM LIABILITY, IRRISPECTIVE OF THE AGREEMENT VALUE SHALL BE OF UP TO 500 DOLLARS. IF YOU HAVE NO CURRENT CK MARKS SOFTWARE LICENSE AGREEMENT OR CK MARKS TECHNICAL SUPPORT OR SERVICES AGREEMENT, THE LIABILITY SHALL BE CAPPED AT 500 DOLLARS.

YOU AGREE TO EXCLUSIVELY RUN THIS APPLICATION FOLLOWING A SUPPORT REQUEST RAISED WITH CK MARKS AND UPON INSTRUCTION FROM CK MARKS STAFF TO RUN THIS APPLICATION IN ORDER TO GRANT REMOTE ACCESS TO YOUR SYSTEM. YOUR SYSTEM WILL BE ACCESSIBLE REMOTELY ONCE THIS APPLICATION IS RUNNING. YOU AGREE TO EXIT THIS APPLICATION ONCE THE SUPPORT SESSION HAS ENDED AND AGREE NOT TO TAMPER OR REVERSE ENGINEER THIS APPLICATION.

CK MARKS AND ITS VENDORS AND LICENSORS MAKE NO WARRANTIES OF ANY KIND WITH REGARD TO THE TECHNICAL SUPPORT SERVICES PROVIDED HEREUNDER. CK MARKS AND ITS VENDORS AND LICENSORS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE TECHNICAL SUPPORT SERVICES INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL CK MARKS OR ITS VENDORS OR LICENSORS BE LIABLE FOR (I) ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR (II) ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE PROVISION OF TECHNICAL SUPPORT SERVICES OR THE SOFTWARE / SYSTEMS USED TO GRANT SUCH SERVICES.
